All the administration has to do is to define "frivolous lawsuit"
without a trial on the merits. We have many legal procedures for
weeding out unmeritorious lawsuits -- demurrers, motions for summary
judgment, etc. But I think what Bush means by "frivolous" is lawsuits
against the wrong people. There's nothing wrong with protecting the
medical profession by providing them with broad immunities, but we
should take care that we are doing it to protect the innocent, not to
protect incompetent practitioners for the sake of insurance company
profits. Political motive is very much an issue when considering any
proposed legislation.
