Hi All, I am not sure where I can post this one and this forum seemed general enough. My question is whether I can hold our company's immigration lawyer accountable for the following situation, and based on the presented facts. 1. Our company immigration lawyer filed for and got my H1 Visa approval 2. During the course of this year, she claims that she got instruction from someone in my company to send a notice of cancellation (of my visa) to the INS. 3. She claims that she does not recall WHO sent her that request 4. She acted on the request and sent that cancellation notice to the INS 5. When we found out the mistake and informed our lawyer, she said that she had taken remedial steps by faxing them a notice asking INS to ignore the cancallation. 6. Apparently (according our lawyer) INS has not acted on the initial cancellaton notice and my visa remains valid. 7. She remains smug that my visa will not be cancelled 8. Other people I have spoken to say that there is no guarantee of this and my visa might still be cancelled anyway. 9. 9 months have passed between the cancellation notice issued by our lawyer and the notice to ignore the cancellation. 10. If my Visa is indeed cancelled now, then it will be done in retrospect i.e. the date of the original cancellation notice. This means that I would have been out of status and will have to leave and NOT return for the next 3 - 10 years. Needless to say that this will ruin my career here. My questions: 1. The lawyer claims that she does not 'remember' who sent her the request to cancel my visa. I find this impossible to believe considering that this is a very serious matter. So it is possible that no one actually sent her that request and she made a mistake that she is trying to cover up. OR, it is also possible that someone in my company did this on purpose, but isnt she supposed to remember / record whom shuch requests came from? Isnt she accountable? And if she is, then what action can I take? I know that whatever happens, I might not be able to save my Visa, and this might ruin my career, but I want to make sure that I take appropriate action against whoever is resposible for this. I know that this is a long posting, but this is the only way I could present the facts.
