Kobe case might not go to California

DENVER (Reuters) - Attorneys for the Colorado woman who accused basketball
star Kobe Bryant of rape are re-thinking a plan to sue the Los Angeles Laker
in his home state of California even though damages there could be greater
than in Colorado, one of her lawyers said on Monday.
"We're making final decisions on that right now. It seems to me the defense
is delaying and we want the case to go forward," Lin Wood, an attorney for
the woman who was 19 when she said Bryant attacked her in a Vail-area resort
last year, said. "The issue we're looking at is whether this is worth the
trade off," he said.
Criminal charges against Bryant were dropped on Sept. 1 after the woman, who
received death threats and was embarrassed by court mistakes that made her
name public, said she did not want to proceed.
In August, the woman sued Bryant in federal court in Denver, seeking
monetary damages. But because Colorado has a strict cap on damages, her
legal team said last month it was considering suing the married father of
one in California state court.
The burden of proof for a plaintiff in a civil lawsuit is lower than in
criminal cases because a defendant faces money damages and not the risk of
prison.
Wood is still trying to question Bryant under oath. A recent planned
deposition was delayed after Bryant's lawyers asked a judge to order the
woman's attorneys not to ask Bryant about his sexual past. "I plan to have
some quality time with Mr. Bryant," Wood, in Denver federal court for
another case, said.
Bryant's lawyers want a federal judge to enter a confidentiality order to
keep information from the deposition out of the public's eye.
The woman's name was made public as a condition for proceeding with the
civil case in federal court, but many media organizations are not
identifying her.

Including the current one -- although they happily continue to identify

What was her name again.......oh yeah, KATELYN FABER or something,
right?
How @$#*ing ridiculous is it that after all this time with all
of the leaks from court paperwork and her name plastered all over
the Internet, some "mainstream media outlets" *still* don't use her
name?? Sure, there's probably a hermit who lives in a cave somewhere
who hasn't heard her name, and obviously we need to protect poor
Katelyn's privacy from this one remaining person.
Jeezus, it's hard to believe the idiocy sometimes.
