HC stays principals' appointment

Taking a strong exception to the City Government's
failure to implement the provision for three per cent
reservation for disabled persons in government jobs, the
Delhi High Court has stayed appointment of 90 principals
for which applications were invited in July 2004.
The order came from Justice Vikramajit Sen on a petition
by All India Federation of the Blind which complained
that disabled persons were not being given three per cent
reservation as required under the disabilities act.
"No appointments to the posts of principal be made till
the next date of hearing," Justice Sen ruled, asking the
Government to respond to the petition by May 11.
"Even though the Disabilities Act has been on the statute
book for almost a decade, it is evident from the number
of cases which are brought before the court, that only
cosmetic adherence to the act takes place. There can be
no excuse for the Government of NCT of Delhi, or the
UPSC, or the Department of Personnel and Training, not to
have adhered strictly to at least the minimum mandate of
the said act, that is, reservation of three per cent for
the three categories of disabled persons," the court
said.
The court also pulled up the Union Public Service
Commission for its "apathy" towards handicapped persons
in our society and failure to comply with the provisions
of Disabilities Act.
Out of the 90 vacancies only one post was meant for
disabled persons, petitioner's counsel SC Vashisht
submitted. His submission was countered by Delhi
Government counsel Kanika Vadhera who said a corrigendum
was issued in the Employment News dated 8-14 January this
year increasing the reservation from one per cent to
three per cent and extending the date for submission of
application forms till January 27.
