How can I get a felony conviction removed?

"QA2008"
3/10/2008 10:15:38 AM

Hi, I was convicted of an armed robbery
in 1999 in Michigan. I have not been into any trouble
since. I am about to graduate from college and would
like to have the felony conviction removed. I obviously
greatly fear the felony conviction is going to severely
decrease my employment opportunities. Sadly, I do
not have any money to pay for a lawyer. I am wondering
if anyone has ideas?
Thanks in advance!

I Don't Know anything about MI Law...
That Said, what you're after is To Expunge The Record... [Of Your
FELONY Conviction]...
In Colorado, [And as far as I know, Colorado is *UNIQUE* in This
Regard] a FELONY is Automatically Expunged 10 Years after "Separation"
from the State Criminal Justice System... [Which INcludes Time on
Parole]...
Thus, 10 Years AFTER Successful Completion of a Parole Term, The
Felony, As a Matter of Administrative Function, is Automatically
Expunged, w/o The Necessity of Further Executive/Admin/Court
Process...
IN New Mexico, Expungement is a Matter Of Petitioning The
Govenor... [Pretty Please... I've Been a Good Boy... Can I Have My Gun
& Vote back?]...

Contact the Distric Attorney's office where you were convicted,
ask them if State Statute allows for expungement or sealing of
convictions (doubtful), and if it does, would they be opposed to
your application.
Your only other alternative is a Pardon, either Governor's or Presidential.
You'll need even more $$ payola for one of those.

The president has no authority to pardon people convicted of state
crimes. Presidents can only pardon federal convicts.

Care to provide any legal citation whatsoever for your claim? Failing
that, just one instance of a president pardoning a state convict at some
point in the 200+ year history of the nation will do.
Betcha can't.

U.S. Constitution, Article II, Section 2:
The President shall... have power to grant reprieves
and pardons for offenses against the United States,
except in cases of impeachment.
You'll note that it says nothing about offenses against the various
individual states.
And then there's Wikipedia, which I'm sure you'll disparage in a
desperate and futile effort to save face, but which is nevertheless
entirely accurate in this case:
The pardon power of the President extends only to
offenses cognizable under U.S. Federal law. However,
the governors of most states have the power to grant
pardons or reprieves for offenses under state criminal
law. In other states, that power is committed to an
appointed agency or board, or to a board and the governor
in some hybrid arrangement.

In addition to Federal Offenses, the President's pardon power extends to
convictions obtained in the Superior Court of the District of Columbia and

Ah, so this is how you're going to try and avoid your latest abject
embarrassment.
(1) You flat out told the original poster that one of his options for a
violation of state law was a presidential pardon.
(2) When the inaccuracy of that statement was pointed out to you, you're
response was (and I quote), "Complete BULLSHIT!"
(3) When you failed to provide even one instance of *any* president in
U.S. history *ever* pardoning a state convict and when legal citations
were provided showing you the limitation on the presidential pardon
power to federal law, you then tried to confuse the issue by throwing
out military courts-martial and pardons in Washington, DC.
(4) And finally, when it was pointed out to you that both those things
are also matters of federal law, not state law, you suddenly just
declared the whole thing a "strawman".
One can only conclude that either you are woefully ignorant of the true
definition of the term "strawman" or you're so full of #@($, your eyes
are brown.
I'm betting on the latter.
[I could take a page from your book here and start accusing you of
lying, since that's what you do whenever anyone else misstates the law.
Of course I'm sure you have some convenient rationalization as to why
your own standards don't apply to you.]

Here is some info from the Michigan court system.

You may also want to contact your local Public Defender's office for
assistance. I do not know about your jurisdiction, but many Public
Defenders' offices do offer free assistance with expungement of past
convictions.
